On Tuesday, November 28, 2006 a Delaware Department of Transportation (DelDOT) / American Council of Engineering Companies of Delaware (ACEC Delaware) Transportation Committee Partnering Meeting was held at the Delaware Department of Transportation (DelDOT) Administration Building, 800 Bay Road, Dover, Delaware.

 

A summary of the conversations held at the meeting is provided on the following pages:

 

 

 

ADMINISTRATION ISSUES

 

A.ΚΚΚΚΚΚΚ New Agreements

 

1.                  DelDOT is in the final stages of preparing several new Contract Agreements for signatures.Κ Approximately 22 Agreements should be sent out over the next 2 weeks.

 

2.                  DelDOT requested that consultants and their subs be responsive with pre-award audit requests in order to expedite the process.

 

B.ΚΚΚΚΚΚΚ Overhead & Fixed Fee

 

3.                  A working group has been established to continue discussions on the implementation of the new overhead and fee policies.Κ The first meeting was held on November 17, 2006.Κ Members of the working group consist of Marti Dobson, John Eustis, Jim Hoagland, Scott Rathfon, Ray Harbeson, Dave Charles and Ted Januszka.

 

4.                  In summary, the meeting on the 17th involved a discussion on the concern of ACEC Delaware member firms with what is believed to be a low allowable fixed fee.Κ ACEC Delaware provided some information on surrounding states as an example of how they are implementing the new FHWA overhead requirements and how they are applying fixed fee/profit on their contracts.

 

5.                  ACEC Delaware will continue to gather information from Delaware member firms, other States, and ACEC National for further discussion.

 

6.                  Marti Dobson will schedule another meeting for January 2007.

 

B.                Rate Increases

 

7.                  The working group also briefly discussed DelDOTβs policy on Rate Increases/Escalation.Κ The ACEC Delaware concern is primarily with the DelDOT review and approval process and whether it may be too restrictive in todayβs competitive market.Κ We agreed to continue these discussions at the working group level.

 

C.                DelDOT Errors and Omission (E/O) Policy

 

8.                  ACEC Delaware questioned whether DelDOT had a chance to review the comments on the E/O Policy that were submitted in July 2006.Κ Evidently something slipped through the cracks and DelDOT was not in possession of the comments.Κ ACEC Delaware will resubmit the comments for review.Κ Fritz Schranck stated that he would be happy to review ACECβs Draft E/O Policy and that DelDOT is open to suggestions on how to update the current E/O policy.

 

D.                Review of Consultant Proposals

 

9.                  At a previous meeting it was brought up that some member firms would like to have access to previous γLetters of Interestδ submitted by their competitors.Κ DelDOT stated that they do not allow this practice but would keep an open mind if ACEC Delaware firms agree with the idea.Κ A survey of ACEC Delaware member firms was conducted and the responses came back split therefore we did not make a recommendation to DelDOT and they are going to maintain the current practice.

 

SPECIFIC ISSUES

 

A.ΚΚΚΚΚΚΚ TIS Reviews

 

10.             A concern was raised with the amount of time it takes to get comments back on TIS submissions.Κ DelDOT is aware of this concern and is working on trying to improve the situation.Κ A meeting will be held on December 6th with the Engineering community to discuss DelDOTβs proposal.

 

B.ΚΚΚΚΚΚΚ Subdivision /Entrance Plan Reviews

 

11.             A concern was also raised with the review time for Subdivision/Entrance Plans.Κ Input from ACEC Delaware member firms is that the situation has been improving in Kent and Sussex Counties but that New Castle County continues to be a concern.

 

12.             One general concern was the accessibility to DelDOT personnel and the lack of responses to phone calls and e-mails.

 

13.             DelDOT mentioned that the quality of the plan submissions and amount of resubmissions puts a burden on the staff and they hope that the new manual will help improve the situation.

 

C.ΚΚΚΚΚΚΚ Updates to Entrance Manual and Subdivision Street Guidelines

 

 

14.             Draft DelDOT Entrance Manual and Subdivision Street Guidelines is out for review.ΚΚΚ DelDOT is hoping to get comments back quickly so they can determine if a public workshop is necessary.

 

D.ΚΚΚΚΚΚΚ SB 284 Procedures

 

15.             The Policy is complete and was posted on November 11th.Κ There is a 30 day comment period.

GENERAL ISSUES

 

A.ΚΚΚΚΚΚΚ New and Breaking Issues with DelDOT

 

16.             The FY 2007 Capital Transportation Program (CTP) is being reviewed internally and the Governor will receive the final CTP draft in January 2007.Κ Formal approval would be received in June 2005.ΚΚ DelDOT anticipates the need for additional revenue to fully fund the CTP.

 

B.ΚΚΚΚΚΚΚ Future Requests for Consultant Services

 

17.             There are no current requests for Consultant services on the street.Κ An RFP for ITS services may be coming out in the near future.

 

18.             The question was asked about the future breakdown of US301 design services.Κ DelDOT mentioned that it was not decided yet

 

C.ΚΚΚΚΚΚΚ Future of γInnovative Contractingδ in Delaware

 

19.             The only project that is currently being considered as a Design/Build is the SR1/I-95 Interchange.Κ This project will not start for a while.

 

20.             The Indian River Inlet Bridge Design/Build is moving ahead.Κ The Draft Technical proposals are due December 20th and the Final Technical proposals are due January 1st January 31st.Κ The price proposal is due February 23rd.

 

D.ΚΚΚΚΚΚΚ Legislative Issues

 

21.             ACEC Delaware asked if DelDOT needed any support for pending and/or current legislation.Κ Nothing was needed at this type.Κ Ralph Reeb mentioned that Land Use issues may be coming up when Legislatures begin session.

 

22.             ACEC Delaware offered assistance with reviewing and supporting bullet items that are proposed to the Joint Finance Committee.

 

FUTURE TOPICS

 

23.             Traffic is working on updates to the Traffic Control Manual and expects to have a draft out in late January.

 

24.             A Federal Law has been passed and will be in effect on November 24, 2008, that will require Class 2 Safety Vests be worn by any pedestrian that is within the ROW of a Federal Aid Highway.

25.             The next DelDOT/ACEC Delaware Meeting is scheduled for Tuesday, January 23, January 30, 2007 at 1:30 p.m. at the DelDOT Administration Building in Dover, Delaware.
