Re:                   NCC Partnering Meeting Minutes – July 13, 2009

 

 

 

At 2:00 PM on Monday, July 13, 2009, the NCC Partnering Committee met with New Castle County’s Land Use Department.  The following topics were discussed:

 

1.              Enhanced Review (Two Step) Process Ordinance – This ordinance is expected to be introduced during the last week in July.  It is expected to take effect January 1st, 2010.

 

2.              “Smart Code” Ordinance  - This ordinance was introduced during the week of July 6th.  It is expected to be passed by Council in late August or September.

 

3.              “BRAC” Amendments – The County expects to introduce an ordinance to enhance opportunities for mixed use development after the “Smart Code” ordinance is approved.

 

4.              Small Business Incentives – The County expects to introduce an ordinance providing incentives for small businesses in August.

 

5.              Omnibus Ordinances – The County is working on two omnibus ordinances making minor changes such as modest landscape requirement reductions, and other clarifications.  They will provide these to us for our comments before they are introduced.

 

6.              Sign Code Ordinance – Ted Williams is leading a committee that is working on a complete review and revision of the sign code.

 

7.              Construction Shutdowns – Mike Clar is finalizing the policy and it is expected to be effective soon.  We will need to add notes to our plan referencing the requirements of the policy.  We suggested the County review this ordinance with the DCA and HBA since they will be significantly impacted.  They thought that was a good idea and will do that at their next “Nuts and Bolts” meeting.

 

8.              Sediment & Stormwater Checklist – We reviewed the new checklist and John Gysling is making final revisions.

 

9.              Electronic CCR Reviews – The County hopes to have a workshop on the process for the CCR’s and engineers in August and implement electronic reviews in September.  The County will work on allowing us to print the electronic page after we have entered the review information, for our record and distribution.

 

10.           Introduction of Rain Tank Construction Check List – We reviewed a few comments on this checklist.

 

11.           Submission of complete applications for all stages of review – We reviewed ideas on improved submission requirements, including having each submission be separated into separate packages for the separate divisions.  We also discussed New Castle County developing a detailed list of what was required for each type of submission.

 

12.           Finalization the UDC definitions for Non-delineated floodplain, Drainage-way, Swale, and Riparian Buffer Area (as it relates to a watercourse) – New Castle County distributed proposed revisions to definitions.  We will review and discuss at the next meeting (see attached).

 

13.           Release of the trial procedure for bio-retention with in-situ soils (see attached) – We reviewed the County’s proposed procedures.

 

14.           Re-inspection Policy – The County presented their policy for re-inspections including fee requirements (see attached).

 

15.           Next Meeting – The next scheduled meeting with Land Use will be held on September 14, 2009 (to eliminate conflicts with Labor Day) at 2:00 PM, in the Land Use office.
