Re: NCC Partnering Meeting Minutes – December 7, 2009
At 3:00 PM on Monday, December 7, 2009, the NCC Partnering Committee met to review topics to include on the agenda for the next meeting with New Castle CountyÕs Departments and other local municipalities. The following topics were discussed.
Topics for Discussion with Land Use include:
1. ÒBRACÓ Amendments (Small Business Incentives) – We will review the status of this ordinance.
2. Sewer Ordinance (#09-071) – We will review the status of this ordinance.
3. Sign Code Ordinance – We will review the status of this ordinance.
4. Construction Shutdowns – We will check on the status on this policy and their use of an interested parties notification list.
5. Electronic CCR Reviews – We will check on the status of this intiative.
6. Finalization the UDC definitions for Non-delineated floodplain, Drainage-way, Swale, and Riparian Buffer Area (as it relates to a watercourse) – We will review the status and our thoughts and concerns about these definition changes. We owe them backup to support our recommendation of limiting non-delineated floodplain calculations to 50 acre watersheds.
7. Water Management Agreement - We will review the status of this initiative.
8. DAPE Engineering Practice Assessor – We will review the impact of DAPEÕs initiative.
9. Turbidity Requirements – We will review the CountyÕs thoughts on EPAÕs proposed requirements for construction site runoff.
10. Site Plan Review Process – We will review the CountyÕs process for reviewing Site Plans to determine if they consider it to be a two step or one step process.
11. LDIA Bonding – We will review the possibility of rescheduling the bonding requirement to be before issuing the building permit and also phasing the requirement to match the Record Plan phasing so the developer does not have his bonding tied up for an entire project even though some phases wonÕt be constructed for a number of years.
12. Landscaping Requirements – We will explore the feasibility of revising the UDC requirements to make them more reasonable and practical.
13. Parking Requirements - We will explore the feasibility of revising the UDC requirements to make them more reasonable and practical.
14. Sidewalk Requirements - We will explore the feasibility of revising the UDC requirements to make them more reasonable and practical.
15. Next Meeting – The next scheduled meeting with Land Use will be held on January 11, 2010 at 2:00 PM, in the Land Use office.
Issues removed from the formal agenda, but kept on our list to remind us to keep track of progress:
1. Property Monumentation – We will add this to the discussion on the omnibus ordinance.
Possible topics for future meetings:
1. Steep Slopes – At some point we will try to suggest a modified way of delineating steep slopes that will be easier than the current method. We will hold off this discussion until after the Water Management Code is done.
Topics for discussion with Special Services include:
1. Sanitary Sewer Design Review Time Frames – Update of review time frames.
2. Northern Sewer District – Update of improvements programs.
3. Southern Sewer District – Update of improvements programs.
4. Checklists, Guidelines, Specifications, and Design Policies – Update of revisions and review of our comments.
5. Next Meeting – Our next meeting is scheduled for January 25th, 2010 at 2:00 PM. I will confirm with Special Services.

Re: NCC Partnering Meeting Minutes – January 11, 2010
At 2:00 PM on Monday, January 11, 2010, the NCC Partnering Committee met with New Castle CountyÕs Land Use Department. The following topics were discussed:
16. ÒBRACÓ Amendments (Small Business Incentives) – Currently in the ExecutiveÕs Office for a final review of the ordinance.
17. Sewer Ordinance (#09-071) – Currently at County Council.
18. Sign Code Ordinance – A meeting will be held on the rough draft at the end of this month, and it looks like it will be distributed sometime in February.
19. Construction Shutdowns – As requested, the County is looking at re-instituting the Interested Party notification list. They are still working out some of the ÒbugsÓ and looking at developing the specific groups/distribution lists to be notified. They will be asking us to distribute a sign-up list in the near future.
20. Electronic CCR Reviews – The workshops went well. About two (2) or three (3) large firms did not participate in the workshops. The County is looking into a way for firms to be able to print the CCR report after they have been completed.
21. Finalization of the UDC definitions for Non-delineated floodplain, Drainage-way, Swale, and Riparian Buffer Area (as it relates to a watercourse) – Doug Eitelman reviewed some ÒgeneralÓ calculations he performed to show that the 50-acre drainage area was somewhat of a ÒrealisticÓ area for defining non-delineated floodplains. We also discussed the area limitations for other jurisdictions. As a result, we are to prepare a brief ÒsummaryÓ of these calculations for the County to indicate how the 50-acre area was determined.
22. Water Management Agreement – The County is provided comments on the ACEC comments and supplemental comments. Some of the specific items are being reviewed by the County Law Department. If deemed necessary, we will provide responses to the County comments.
23. DAPE Engineering Practice Assessor – The County has had some discussions with DAPEÕs Engineering Practice Assessor and this is an on-going process.
24. Turbidity Requirements – The County is working with DNREC to develop a strategy and hope to have one in six (6) months. There is a meeting on February 18, 2010, between DNREC and the County to discuss this topic.
25. Site Plan Review Process – The question is why is there an Exploratory Sketch Plan comments for Site Plan submittals? The County Planning/Engineering Departments are going to work to resolve this.
26. LDIA Bonding – There is a group being convened consisting of engineers, owners, and developers, to look into LDIA Bonding requirements, as developers have indicated there is difficulty obtaining bonds for large/long term/multiphase projects and/or it ties up their financing capacity for extended time periods.
27. Landscaping Requirements – A committee will be formed upon ACECÕs request to look into the feasibility of revising the UDC requirements to make them more reasonable and practical (to be combined with Parking and Sidewalk requirements).
28. Parking Requirements – A committee will be formed upon ACECÕs request to look into the feasibility of revising the UDC requirements to make them more reasonable and practical (to be combined with Landscaping and Sidewalk requirements).
29. Sidewalk Requirements – A committee will be formed upon ACECÕs request to look into the feasibility of revising the UDC requirements to make them more reasonable and practical (to be combined with Landscaping and Parking requirements).
30. Enhanced Review Process – There have been two (2) to three (3) submissions and itÕs been going well. The County is looking into creating a new Exploratory Sketch checklist for the initial submission that is more Òstraight forwardÓ than the description, as outlined in Appendix II.
31. Next Meeting – The next scheduled meeting with Land Use will be held on March 1, 2010, at 2:00 PM, in the Land Use office.
